ATV4FUN – Limited Warranty Agreement (Legal Version)
This Limited Warranty Agreement (“Warranty”) is issued by ATV4FUN to the original retail purchaser (“Purchaser”) of any all‑terrain vehicle (“ATV”) sold by ATV4FUN. By accepting delivery of the ATV, the Purchaser agrees to the terms and conditions set forth herein.
1. Dealer-Assembled Units With Pre‑Delivery Inspection (PDI)
1.1 Coverage. ATVs assembled by ATV4FUN and subjected to a full Pre‑Delivery Inspection (“PDI”) are covered by a limited warranty against defects in materials or workmanship.
1.2 Scope. This warranty includes parts and labour necessary to correct verified manufacturer defects.
1.3 Limitations.
This warranty does not cover:
• Normal wear items (including but not limited to belts, brakes, bulbs, chains, tires, and batteries)
• Damage resulting from misuse, abuse, neglect, improper maintenance, or unauthorized modifications
• Damage arising from commercial, rental, or competitive use unless expressly stated otherwise
1.4 Non‑Transferability. Warranty coverage applies solely to the original Purchaser and is non‑transferable.
2. Open‑Box, Crate, or Customer-Assembled Units
2.1 Coverage Period. Open‑box units, crate units, or ATVs assembled by the Purchaser are covered by a one (1) week parts‑replacement‑only warranty beginning on the date of purchase.
2.2 Scope of Coverage.
This warranty is strictly limited to replacement of defective parts confirmed to be manufacturer defects.
2.3 Exclusions.
The following are expressly excluded from coverage:
• Labour, diagnostics, adjustments, or repairs of any kind
• Damage caused by improper assembly, incorrect wiring, incorrect fuel mixture, battery installation errors, or failure to follow setup instructions
• Physical damage, cosmetic damage, or impact damage
• No‑start conditions resulting from improper assembly, setup, or maintenance
• Any condition not directly attributable to a verified manufacturer defect
2.4 Condition Requirement. Units must be returned in the same condition as sold for any warranty evaluation. Altered, damaged, or modified units are not eligible for warranty consideration.
3. No‑Start or Damaged Units
3.1 Exclusion of Coverage.
ATV4FUN provides no warranty coverage for ATVs that:
• Fail to start due to improper assembly, incorrect setup, or lack of PDI
• Exhibit physical damage at the time of pickup, delivery, or return
• Are damaged during transport, assembly, or use by the Purchaser
3.2 Manufacturer Defects Only.
Only defects proven to originate from the manufacturer are eligible for warranty consideration.
4. Warranty Service Requirements
4.1 Service Location. All warranty evaluations and services must be performed exclusively by ATV4FUN at its designated service location.
4.2 Transportation. The Purchaser is solely responsible for all transportation, towing, or delivery costs associated with warranty service.
4.3 Inspection. Warranty claims are subject to inspection and verification by ATV4FUN. Warranty determinations are made at the sole discretion of ATV4FUN.
5. Proof of Purchase
5.1 Requirement. A valid, original receipt must be presented for all warranty claims.
5.2 Failure to Provide Proof. Claims without proof of purchase will be denied.
6. Disclaimer of Additional Warranties
6.1 No Other Warranties. Except as expressly stated herein, ATV4FUN makes no other warranties, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.
6.2 Limitation of Liability.
ATV4FUN shall not be liable for incidental, consequential, or indirect damages, including but not limited to loss of use, loss of time, loss of income, or transportation costs.
7. Governing Law
This Warranty shall be governed by and interpreted in accordance with the laws of the Province of Ontario.
